Parking 4 You - Outdoor and Covered – Port
ARTICLE 1º DEFINITION
- For all purposes the parties agree to the following conditions:
- Company: Low Cost, We Park for You Ltda.;
- Parking 4 You: or simply Parking, managed by the Company (Low Cost, Estacionamos por Si Lda.), (EXTERIOR) fenced on the sides with restricted access to third parties, Covered (INDOOR) with restricted access to third parties and facilities of other entities, which have an agreement with Parking 4 You, within a maximum radius of 2km.
- Client: Individual or legal entity that will use the the park under the conditions set out in this agreement;
- Vehicle: Motor vehicle or motorcycle that the customer, under any legitimate title, has at his disposal, not including any accessory goods not incorporated into the same, and that are adaptable;
- Airport: Francisco Sá Aries in whose vicinity Parking 4 You is located;
ARTICLE 2º SUBJECT OF THE CONTRACT
The purpose of this contract is to provide the facilities of Parking 4 You and the facilities of other entities that have an agreement with Parking 4 You within a radius of 2km, for the periods agreed between the customer and the Company and in compliance with the other conditions set out in the following clauses:
ARTICLE 3º DURATION OF CONTRACT
This contract shall have the duration agreed between the Client and the Company, without prejudice to this period being able to be extended or shortened, upon communication between the parties.
ARTICLE 4º CONDITIONS
- Without prejudice to the provisions of this Contract, upon signing the same, the Customer will be assured the following benefits.
- Vehicle storage at Parking 4 You and facilities of other entities that have an agreement with Parking 4 You within a 2km radius, for the duration of this Contract:
- Parking 4 You reserves the right to move the vehicle between the parks and facilities of other entities that make their parks available to it, in order to better optimize the parking spaces available.
- Removal of the Customer's Vehicle from the Airport (Valet/Driver Car) until to Parking 4 You and vice versa, whichever is specifically defined between the parties, will be carried out by Company employees duly identified and authorized for this purpose;
- Transportation will be free for the Customer and their companions at the Parking 4 You Park until to the Airport and vice versa. Will be made available by the Company, which is specifically defined between the Customer and the Company;
- Other benefits may be provided or offered by the Company, notably vehicle washing, provided that these are agreed in advance with the Customer;
- The granting of benefits granted in the previous item presupposes that:

- Parking 4 You reserves the right to move the vehicle between the parks and facilities of other entities that provide the company its parks to better optimize the parking spaces it has.
- Authorizes the driving of the car by Company employees in the event of It is possible to request and agree to collect the vehicle from the Airport to Parking 4 You and facilities of other entities that have an agreement with Parking 4 You, within a radius of 3km from the airport, without the need for prior agreement.
PURCHASE PROCESS AND ONLINE PURCHASE
To purchase the Services offered on the Website, the Customer must follow the instructions displayed on the screen; and accept the purchase by following the instructions above.
If the Customer is a natural person, he/she must be at least 18 years old to acquire the Services.
Hiring will be carried out by the customer, by filling out the different forms that are presented throughout the purchasing process and express acceptance by the Customer of these Terms and Conditions, as well as all the conditions applicable to the contracted product. In the purchase process, once the form submission is completed, pressing the "Buy and Pay" button will complete the purchase. the process and will involve the Customer's full acceptance of the Parking 4 You commercial proposal, as well as the applicable conditions, redirecting to a purchase confirmation page on the screen, which the Customer can print.
- If you choose to purchase the parking service with online payment (pre-payment), the following refund methods apply:
- 100% if you cancel your reservation at least 48 hours before the service;
- 50% if cancelled between 48 hours and at least 24 hours before the service;
- 0% if canceled less than 24 hours before service:

If the withdrawal is later than the agreed date, the Customer will settle the the pending days (upon collection of the vehicle), paying the amount at the daily prices in force at date of vehicle collection.
- If the Customer contracts the service for more than one month and with periodic payments, payments will be made through direct debit receipts to be issued by the Company between the 1st and 5th of each month. In case of return of the invoice, the Company may charge the Customer for the return costs.
- In the case of contracting the parking service for a fixed period, payment will be done in advance. In the event that the Customer decides to collect the Vehicle before the designated date, he may do so without the right to reimbursement of any amount by paying the total price agreed in this Contract. If the withdrawal is later than the agreed date, the Customer will settle the amount the value at the daily prices in force at date of collection of the Vehicle, unless expressly indicated in this Contract.
- If the customer contracts the Battery Recharging Service, the Customer authorizes the Company to connect the cables to the battery terminals.
ARTICLE 5º COMPLEMENTARY CONDITIONS AND PRICE
- The delivery of the vehicle will depend on the procedure agreed between the Customer and the Company, that is, by direct delivery to the 4 You Parking Lot or by collecting the Vehicle at the Airport (Valet/Driver Car) before boarding by one of the company's employees, duly uniformed and identified, always taking into account the check-in procedures referred to in clause 7.
- Receipt of the car will depend on upon prior request from the Customer in accordance with one of the following methods:
- By prior indication (through reservations), at the time of delivery of the vehicle, by telephone or email, indicating flight, company, date and time of return of the Customer, with indication of the delivery method that may be be direct (delivery at the terminal, Valet/Driver Car) or free transport from the Terminal to to Parking 4 You
- By communicating with a duly identified employee of the Company present at the Airport or by telephone contact to the Company informing the Customer of the presence and requesting delivery of the Vehicle at the Airport or free transportation to the Airport. to the Park Parking 4 You . The Customer accepts that in this case the procedure for receiving the car may be delayed or denied.
- The price to be paid by the Customer will be what is stated in the price table displayed at the Parking 4 You Park or the value resulting from the online simulator on the website (each fraction is 24 hours, partial periods or hours are not billed). Payment will be carried out online (prepaid), or at the final act of handing over the summer, taking into account the chosen STANDARD/INDOOR park, the requested procedure (Park/Valet) and the period of use (always at TPA, we do not accept cash).
ARTICLE 6º CUSTOMER OBLIGATIONS
- The Client undertakes to the Company to:
- Deliver the Vehicle in full mechanical working condition and with all technical checks and inspections, as well as all legally required documentation (under the Portuguese legislation framework) that adequately entitles the availability of the vehicle to the Customer and its movement by the Company's employees under the terms of clause 4.1 b) and c).
- Hand over the vehicle key that allows access to it, the alarm control if it is autonomous and any other control that allows the alarm to be deactivated if necessary;
- Allow access to the interior of the Vehicle and its driving by Company employees, under the terms and for the purposes of clause 4.2.
- Any access to the vehicle is excluded by third parties, with the exception of situations resulting from orders from legal entities, namely, the Public Security Police, judicial officials or entities with public order powers.
- Carry out the check-in and check-out procedures set out in clause 7, signing the corresponding documentation;
- Remove from your vehicle all belongings and goods that are not necessary for driving or parking it (and in particular all personal and/or valuable belongings);
- Authorize the Company, through its employees, to remove from the Vehicle, after delivery, any element incorporated externally but easily detachable, such as antennas and other extra-car accessories which must be be placed back in the vehicle when it is picked up;
- Pay for the service provided, which is the object of this contract, in accordance with the online price list in force at the time of purchase. date;
- Authorize the company to maneuver and park the car in Parking 4 You parking lots and other facilities of other entities that have an agreement with Parking 4 You, within a 2km radius.
- In the event of an accident, customers accept that their vehicles will be repaired at the workshop contracted by Parking 4 You, to the detriment of any other.
- Customers whose car is on public roads, in the event of an accident, must always activate the car's mandatory insurance.
- Respect the check-in/check-out dates and times scheduled by the customer. Failure to comply with the scheduled dates and times may result in delays in delivery or collection, for which the company assumes no responsibility.
ARTICLE 7º DELIVERY AND RECEIPT OF THE VEHICLE
- The delivery of the Vehicle by immediate delivery to the Parking 4 You Park or by collection of it at the Airport (Valet/Driver Car), will have into account the following points:
- The customer must deliver the Vehicle without any material goods that are not an integral part of it, whether in the passenger compartment or in the luggage compartment, namely communication equipment, radios, computers, cameras, clothes, or any other physically appropriated goods, for which Parking 4 You assumes no responsibility;
- The Customer and the Company representative, if the customer requests, must proceed to check-in the Vehicle, in which the An inspection will be carried out inside and outside the vehicle, and photographs may be taken to record any damage, wear or defects that may exist. delivery date. - Receiving the car by the Customer, whether at the Airport or at Parking 4 You, will be preceded by a check-out of the vehicle, with inspection carried out by the customer, in order to confirm, if requested, the vehicle's mileage and fuel, as well as the absence of damage and any liability on the part of the Company. Parking 4 You's liability expires when the vehicle leaves the car park facilities or when it is returned to the airport terminal.

ARTICLE 8º COMPANY RESPONSIBILITY
- The Company will be responsible to the Customer for any damages caused negligently by its employees, strictly in the following cases:
- Damage caused to the Vehicle as a result of handling within Parking4you and other facilities of other entities, which have an agreement with Parking4you within a radius of 2km, under the effects provided for in clause 4.2);
- Any damages suffered by the Customer and their companions as a result of transportation under clause 4.1 c) provided that they arise from an unlawful act involving gross negligence or intent on the part of the Company employee who performs the duties of driver of the transportation Vehicle in question;
- Any other damages resulting from unlawful acts with intent or gross negligence on the part of employees and representatives or agents of the Company and whose liability cannot be excluded under the terms of clause 7.2;nbsp;
- The Company's liability is expressly excluded when it concerns:
- Damages suffered by the Customer in relation to the theft of any goods left in the vehicle after its delivery, in breach of the provisions of clause 7.1 a);
- Any mechanical damage to the Vehicle that is not caused by Company Employees, namely damage caused by third parties as a result of their unlawful intrusion into Parking4you, notwithstanding the fencing, alarm and surveillance systems installed, or by natural causes that cannot be avoided by the Company;
- Parking4you's insurance policy does not cover any damage resulting from natural disasters or adverse weather conditions.
- We are not responsible for isolated glass breakages.
- Recommendation for car delivery. Airlines recommend 2 hours in advance for international flights and 1 hour for domestic flights. Although it only takes a few minutes to receive your vehicle and transfer it to the terminal, parking users must arrive at our facilities 20 minutes before check-in opens. ARTICLE 9º CUSTOMER RESPONSIBILITY
- It is The Customer is responsible for any fines or penalties that the Company has to pay due to any irregularity found in the Vehicle, its documentation or its ownership. Without prejudice to the rights of defense that assist the Company under the terms permitted by Law, the Customer must reimburse the Company for all costs incurred by it, including legal costs with lawyers and solicitors.
- In the event of non-payment by the Customer of the contracted price or any other expenses borne by the company, the company has the right to retain the Vehicle, which will be released as soon as the amount owed is paid in full, which will include the price increased due to the increase in the number of days the vehicle is parked with interest on arrears.
ARTICLE 10º PERSONAL DATA
The data collected about the Customer is also intended to comply with legal obligations and to be used in contractual relationships with Insurance Companies, Banks and other Institutions, with the Company undertaking to maintain confidentiality regarding all data, reserving access to them exclusively to what is necessary for its normal activity. The respective holder is guaranteed, in accordance with Law 67/98, of October 26, (Law on the Protection of Personal Data) the right to access and rectify the same.
In accordance with Regulation (EU) 2016/679 and Organic Law 3/2018, of December 5, on the Protection of Personal Data and guarantee of digital rights, it is informed that your personal data will be incorporated into a data processing whose purpose is the management of the service contracted by the Company. Legitimation is based on the Customer's consent and for the execution of this Agreement. Other bodies of the State Administration, the Autonomous Community of Maia or the Municipality where the Parking 4 You car park facilities are located may be recipients. ARTICLE 11º MISCELLANEOUS PROVISIONS
All communications between the parties resulting in changes to this contract will be made in writing and addressed by the customer to the Company's address, fax or email. And on behalf of the Company they will be sent to the address or email of the Customer indicated in the specific conditions.
ARTICLE 12º AGREEMENT FORUM
The validity, interpretation and effects of this Agreement/Service will be governed exclusively by Brazilian law.
For all matters arising out of or related to this contract, The competent court is the court of the District of Porto, with express waiver of any other, the option being made by the one that is closest to the relevant domicile of the injured party, so that serious inconveniences do not result for the same. The Customer declares to be fully informed and clear about the content of this contract.

- ALL PERIODS ARE 24H, EXCEPT FOR THE LAST DAY WHICH HAS +2 HOURS OF TOLERANCE FOR POSSIBLE DELAYS.
- ALL PRICES INCLUDE ICMS AT CURRENT RATE.
